Municipal Law

Estate Planning & Probate Practice
Estate Planning

Probate Practice
Probate Practice involves both Estate Administration and, potentially, Estate Litigation. It also includes applications to the Court for Guardianship or Conservatorship over incapacitated individuals. Probate Practice is quite nuanced. Our attorneys are well-versed in the field and have the experience necessary to help you navigate the process.
Typically, in administering an Estate, either the Executor (if named in a Will) or the Administrator (if the decedent did not have a Will) is charged with accumulating all assets, paying off all debts, filing any necessary tax returns, completing an accounting and distributing the balance of the estate to the beneficiaries. Our attorneys assist clients in the legal and financial aspects of administering an Estate in order to make the process more efficient.
Estate Litigation takes many forms, but typically it involves either a party is challenging the validity of a Will (usually alleging Undue Influence or Lack of Testamentary Capacity) or the actions of an Executor in

Appellate Practice
The final decision of the trial court is not always the right decision. After the trial court enters its
decision, there may be grounds for an appeal. If an appellate decision was entered, there may still
be an opportunity to file a petition to the Supreme Court.

We regularly handle emergent and non-emergent matters before the Appellate Division and Supreme Court. This is a specialized area of practice with a different set of rules than the trial court.
